Terms of Service

Effective 29 July 2026

These terms are an agreement between you (and the business you represent) and SubbieOS, covering your use of the SubbieOS website, field app and related services (the “Service”). By creating an account or using the Service, you agree to these terms. SubbieOS is operated from Newcastle, New South Wales, Australia.

Your account

You must give accurate account and business details and keep them up to date. You're responsible for activity under your account and for keeping your sign-in secure. Tell us promptly if you think your account has been compromised. You're responsible for the access you grant to your own team members.

Your data and content

Your business data — your quotes, jobs, claims, invoices, customer details, photos and records — remains yours. You grant SubbieOS the permission needed to host, process and display that data solely to provide the Service to you. You're responsible for the accuracy and lawfulness of what you put in, including having the right to store your customers' and crew's details. How we handle personal information is set out in our Privacy Policy.

Not professional advice

SubbieOS is a tool to help you run your business. It is notlegal, financial, tax, accounting or work-health-and- safety advice. Features such as payment-claim timing under security-of- payment legislation, charge-out and margin calculations, tax figures and safety sign-offs are aids based on the information you enter — they don't replace your own judgement or advice from a qualified professional. You remain responsible for meeting your legal, contractual and safety obligations, and for checking the figures and dates before you rely on them.

Third-party integrations

If you connect a third-party service (such as Xero), your use of that service is governed by its own terms, and you authorise SubbieOS to exchange data with it as needed for the feature you enable.

Availability, trials and fees

SubbieOS is being rolled out through a trial-occupancy program, and parts of it are still being built. We aim to keep the Service available and reliable but provide it on an “as is” and “as available” basis, and we may change, suspend or discontinue features. Where fees apply, we'll tell you the price and terms before you're charged.

Your Australian Consumer Law rights

Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law or other laws that cannot lawfully be excluded. To the extent permitted by law, our liability for a failure to comply with a consumer guarantee is limited to re-supplying the Service (or the cost of doing so), and we are not liable for indirect or consequential loss.

Termination

You can stop using the Service and ask us to close your account at any time. We may suspend or end access if these terms are breached or if we need to protect the Service or others. On closure, we handle your data as described in the Privacy Policy.

Governing law

These terms are governed by the laws of New South Wales, Australia, and the courts of New South Wales have jurisdiction.

Changes

We may update these terms from time to time. We'll change the effective date above and, for significant changes, let you know in the app. Continuing to use the Service after a change means you accept the updated terms.
